Judge orders the arrest of Juana Rivas after she fails to appear in court

The Court of First Instance 2 of Granada has ordered the arrest of Juana Rivas, a neighbour from the Granada town of Maracena whose whereabouts are unknown since on 26 July she breached the legal ruling to hand her children over to their father, who was sentenced in 2009 for a crime of causing injury in the family environment, and after she failed to appear on Tuesday at the court which is conducting legal proceedings to decide whether she has incurred in an offence of unlawful retention of minors.

The Court of First Instance 2 of Granada has ordered the arrest of Juana Rivas, a neighbour from the Granada town of Maracena whose whereabouts are unknown since on 26 July she breached the legal ruling to hand her children over to their father, who was sentenced in 2009 for a crime of causing injury in the family environment, and after she failed to appear on Tuesday at the court which is conducting legal proceedings to decide whether she has incurred in an offence of unlawful retention of minors.

After assessing the request of Francesco Arcuri, father of minors and resident in Italy, who did appear in court where he was also summoned this Tuesday, and the opinion of the public prosecutor, in his ruling, which Europa Press has been able to access, the judge noted "the existence of an alleged offence of child abduction".

The ruling also indicates that the State Law Enforcement Authorities "have not been able to locate the accused" and no information on her whereabouts was found "at her home, or the homes of close relatives", therefore, "the law, as always occurs under these circumstances, obliges him to order her arrest and appearance before the court".
