Extremadura's Upper Court finds against the Junta's ESO and Bachillerato curriculum

Extremadura's Upper Court of Justice considers that the distribution of hours of religious education established by the Regional Government in its ESO and Bachillerato curriculum is not aligned with the Lomce. This ruling vindicates the parents' association, Apadex Educación Integral, which had appealed against the Regional Government's decree. The Government of Extremadura has said it will abide by the ruling, but it has already announced an appeal to the Supreme Court.

The decree passed by the Regional Government of Extremadura in June 2016 establishes religion as an optional subject in ESO and reduces it to one hour a week of classes. It also allows one hour a week for the first year of Bachillerato, and eliminates the subject in the second year. The parents' association Apadex appealed to Extremadura's High Court, claiming that the allotted hours were not in line with the law. Now the judges have proven them right.

The Government of Extremadura will obey the ruling, but will appeal to the Supreme Court. According to its spokesperson, Isabel Gil Rosiña, the Executive considers that its decree complies with the law and the Church-State agreement, as well as allowing parents the freedom to choose between religion and ethics.
